OVERVIEW

Welcome to PeekoraLab. The terms "we," "us," and "our" refer to PeekoraLab, an online retail business operating from Ontario, Canada. PeekoraLab operates this store and website, including all related information, content, features, tools, products, and services (the "Services").

PeekoraLab is powered by Shopify, which provides the technical infrastructure used to operate our storefront, checkout, and payments.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your province, state, or country of residence, and that you consent to any minor dependents using the Services on devices you own or manage.

To use the Services, you may be asked to provide information such as your email address and billing, payment, and shipping details. You represent that all information you provide is correct, current, and complete.

Customer accounts are optional at PeekoraLab. You may complete a purchase as a guest. If you do create an account, you are responsible for maintaining the security of your credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to represent our products accurately. Colours and product appearance may differ from how they appear on your screen because of device type and display settings.

PeekoraLab products are intended for learning, discovery, and family use. They are not professional medical, diagnostic, scientific, or laboratory equipment. Products should be used according to their instructions, warnings, and recommended age range. Adult supervision is recommended for younger children.

Product descriptions are subject to change without notice. We reserve the right to discontinue any product and to limit quantities offered to any person, region, or jurisdiction.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. PeekoraLab reserves the right to accept or decline any order. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation requests once an order has entered processing. If we decline, change, or cancel an order, we will attempt to contact you using the email address, billing address, or phone number provided at the time of purchase.

Purchases are subject to return or exchange in accordance with our Return and Refund Policy.

You represent that your purchases are for personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

All prices are listed in Canadian dollars (CAD) unless otherwise stated. Posted prices do not include taxes, shipping, handling, or customs and import charges unless expressly stated.

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed, as set out in your order confirmation email.

Where a product displays a comparison or reference price, that price reflects a price at which the product has previously been offered by PeekoraLab.

Promotions, bundles, and free-gift offers may be governed by their own terms. Where a promotion's terms conflict with these Terms, the promotion terms govern for that promotion. Details of how promotional gifts and bundles are treated on return are set out in our Return and Refund Policy.

You agree to provide current, complete, and accurate payment information, and you represent that you are authorised to use the payment method provided.

SECTION 5 - SHIPPING AND DELIVERY

Shipping terms, destinations, costs, and estimated delivery times are set out in our Shipping Policy.

All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or other events outside our control. Once products are transferred to the carrier, title and risk of loss pass to you, subject to your rights in respect of orders that are lost, damaged, or undelivered as described in our Shipping Policy and Return and Refund Policy.

SECTION 6 - INTELLECTUAL PROPERTY

The Services, including all trademarks, text, images, graphics, video, audio, and the design and arrangement of the site, are owned by PeekoraLab, its affiliates, or its licensors and are protected by Canadian and foreign intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, or transmit material from the Services without our prior written consent.

PeekoraLab names, logos, and product names are trademarks of PeekoraLab. Shopify's name and logo are trademarks of Shopify. All other trademarks on the Services belong to their respective owners.

SECTION 7 - THIRD-PARTY TOOLS AND LINKS

The Services may include access to tools, integrations, and links provided by third parties, which we do not control or monitor. We provide access to such tools "as is" and without warranties of any kind.

Your use of third-party tools is at your own risk, and you should review the terms and privacy practices of the relevant provider. Complaints or questions regarding third-party products and services should be directed to that third party.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

PeekoraLab is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with PeekoraLab. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and PeekoraLab, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with PeekoraLab.

SECTION 9 - PRIVACY

All personal information we collect through the Services is handled in accordance with our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services. Information you submit may be transmitted to and shared with Shopify and third-party service providers that may be located outside your country of residence. See our Privacy Policy for details.

SECTION 10 - FEEDBACK AND REVIEWS

If you submit ideas, suggestions, feedback, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display that Feedback for any purpose, including commercial use.

You represent that you own or have the necessary rights to all Feedback you submit, that you have disclosed any compensation or incentive received in connection with it, and that it does not infringe any third party's rights or contain unlawful, defamatory, obscene, or malicious content.

We may, but are not obliged to, monitor, edit, or remove Feedback we consider objectionable or in breach of these Terms. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.

SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability.

We reserve the right to correct errors and to change or update information, or to cancel orders, if any information is inaccurate - including after you have submitted an order. Nothing in this section limits your rights in respect of defective, materially misdescribed, or incorrectly supplied products.

SECTION 12 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services:

• For any unlawful or malicious purpose
• To violate any applicable law, regulation, or ordinance
• To infringe our intellectual property rights or those of others
• To harass, abuse, defame, intimidate, or harm any person
• To transmit false or misleading information
• To send unsolicited advertising, spam, or chain communications
• To impersonate any person or entity
• To interfere with anyone else's use or enjoyment of the Services

You further agree not to upload viruses or malicious code, to resell or exploit any portion of the Services, to collect other users' personal information, to phish or pretext, to use robots, scrapers, or automated data-extraction tools, or to circumvent security or authorisation measures.

We may suspend, disable, or terminate your access at any time, without notice, if we determine you have breached these Terms.

SECTION 13 - AUTOMATED AGENTS

This section applies if you use, enable, or cause the deployment of an Agent to access or interact with the Services. "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of a person or entity without direct supervision.

An Agent may access the Services only if it identifies itself and operates in accordance with the requirements below, and only if we have not requested that it refrain from doing so. We may limit, including by technical measures, whether and how any Agent accesses the Services.

Agents must: (i) identify in all HTTP/HTTPS requests that the request comes from an Agent, and disclose the Agent's name in the user agent string as "Agent/[agent name]"; (ii) not conceal that access or interaction is from an Agent, including by mimicking human interaction patterns or by completing or circumventing CAPTCHAs; (iii) respond truthfully to any question or prompt seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit, or control Agent access.

SECTION 14 - TERMINATION

We may terminate this agreement or your access to the Services at our discretion at any time without notice. You remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Intellectual Property, Feedback and Reviews, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, and Privacy.

SECTION 15 - DISCLAIMER OF WARRANTIES

Information presented on the Services is provided for general information purposes. We do not warrant its accuracy, completeness, or usefulness, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY PEEKORALAB, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Some jurisdictions do not allow the exclusion of implied warranties, so the above may not apply to you.

SECTION 16 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, PEEKORALAB, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND THOSE OF SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND - INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS - WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM.

Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited.

SECTION 17 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless PeekoraLab, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, payable to any third party arising out of your breach of these Terms, your violation of any law or third-party right, or your access to and use of the Services.

SECTION 18 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed. This does not affect the validity of the remaining provisions.

SECTION 19 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies posted on this site, constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements or communications, including prior versions of these Terms.

SECTION 20 - ASSIGNMENT

You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent. Any such attempt is void. We may transfer or assign these Terms and our rights and obligations without notice to you.

SECTION 21 - GOVERNING LAW

These Terms and any separate agreements under which we provide Services are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada. You and PeekoraLab consent to the exclusive jurisdiction of the courts of Ontario.

This provision does not limit any mandatory consumer rights or protections available under the laws of your country, province, state, or place of residence. Where applicable consumer law provides greater protection than these Terms, that law takes priority.

SECTION 22 - CHANGES TO THESE TERMS

You can review the most current version of these Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. We will notify you of material changes in accordance with applicable law. Your continued use of the Services following the posting of changes constitutes acceptance of those changes.
